By using PhilBrokers, you also acknowledge that your use of the platform is subject to our Privacy Policy, which explains how we collect, use, and protect personal information. If you register as a participating broker, you also agree to comply with the Broker Membership Policy, which forms part of these Terms & Conditions.

2. About the Platform

PhilBrokers operates an online platform where property buyers can discover listings marketed by participating PRC-licensed real estate brokers.

PhilBrokers facilitates property discovery and broker visibility but does not provide real estate brokerage services, represent buyers or sellers, or participate in real estate transactions.

3. Eligibility and Use

By using PhilBrokers, you agree to:

Provide accurate and truthful information.
Use the platform only for lawful purposes.
Refrain from posting misleading, fraudulent, or unlawful content.
Respect the intellectual property rights of others.
Comply with these Terms and all applicable laws and regulations.

4. Broker Membership

Participation as a broker is intended exclusively for PRC-licensed Real Estate Brokers.

Admission to the platform is governed by the PhilBrokers Membership Policy. Eligibility or submission of an application does not guarantee acceptance as a participating broker.

Participating brokers are responsible for maintaining accurate professional information, property listings, and account details.

5. Property Listings

Property listings are submitted and managed by participating brokers.

While PhilBrokers may review listings for formatting, organization, presentation, and consistency with platform standards, brokers remain solely responsible for the accuracy, legality, completeness, and timeliness of the information they publish.

Publication of a listing does not constitute endorsement, certification, or guarantee by PhilBrokers.

6. Buyer Responsibility

Property information is provided for general informational purposes only.

Buyers are encouraged to independently verify all property information, ownership details, pricing, availability, and broker credentials before making any property decisions.

Where appropriate, broker credentials may also be verified through the Professional Regulation Commission (PRC).

7. No Brokerage or Transaction Services

PhilBrokers serves solely as an online platform connecting property buyers with participating PRC-licensed real estate brokers.

PhilBrokers does not:

represent buyers or sellers;
negotiate real estate transactions;
receive or hold payments;
prepare legal documents or contracts;
provide legal, financial, or tax advice; or
guarantee the completion of any property transaction.

Any agreement or transaction entered into is solely between the parties involved.

8. Intellectual Property

The PhilBrokers name, logo, website design, graphics, branding, and original website content are owned by or licensed to PhilBrokers and are protected by applicable intellectual property laws.

Property listings, photographs, and other marketing materials remain the property of the participating broker or their respective owners.

9. Third-Party Links

PhilBrokers may contain links to third-party websites for the convenience of users.

PhilBrokers does not control or endorse these websites and is not responsible for their content, policies, or services.

10. Disclaimer

PhilBrokers provides the website and its contents on an “as is” and “as available” basis.

While reasonable efforts are made to maintain the platform, PhilBrokers makes no representations or warranties regarding:

the accuracy or completeness of property listings;
the availability of listed properties;
the services provided by participating brokers;
uninterrupted or error-free operation of the website.

11. Limitation of Liability

PhilBrokers provides a platform for property discovery and broker visibility and is not a party to any real estate transaction.

Accordingly, PhilBrokers shall not be responsible or liable for:

the accuracy, completeness, or legality of property listings or other information provided by participating brokers;
any misrepresentation, omission, or error made by users or participating brokers;
the availability, condition, ownership, pricing, or suitability of any property;
any negotiations, agreements, disputes, or transactions between users and participating brokers;
any financial loss, damages, claims, or liabilities arising from the use of the platform or any transaction conducted independently of PhilBrokers.

Users acknowledge that real estate transactions involve independent decisions and inherent risks. PhilBrokers encourages buyers and sellers to conduct appropriate due diligence and, where necessary, seek independent legal, financial, or other professional advice before entering into any transaction.

To the fullest extent permitted by applicable law, PhilBrokers shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from the use of the platform.

Platform Availability

While PhilBrokers takes reasonable measures to maintain the availability, security, and integrity of the platform, we do not guarantee uninterrupted access or that the website will be free from errors, technical failures, or security incidents.

PhilBrokers shall not be liable for any interruption of service, website downtime, system failure, cyberattack, unauthorized access, malware, data corruption, or loss of information, including the temporary or permanent loss of broker profiles, property listings, photographs, messages, or other user-submitted content.

Users are encouraged to maintain their own copies of important information and marketing materials submitted to the platform.

12. Suspension or Termination

PhilBrokers reserves the right to suspend, restrict, or terminate user accounts or remove listings that violate these Terms, the Membership Policy, applicable laws, or platform standards.

13. Force Majeure

PhilBrokers shall not be liable for any delay, interruption, or failure to perform its obligations resulting from events beyond its reasonable control, including but not limited to natural disasters, acts of government, armed conflict, civil unrest, labor disputes, widespread power outages, failures of public telecommunications or internet infrastructure, epidemics, pandemics, or other unforeseen events that materially affect the operation of the platform.

14. Changes of these Terms

PhilBrokers may revise these Terms & Conditions from time to time.

Updated versions will become effective upon publication on this website. Continued use of the platform after such changes constitutes acceptance of the revised Terms.

15. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the Republic of the Philippines.
